John Stockdale’s article “Analyzing a Professional’s Personal Goodwill under Chapter 7 of the Bankruptcy Code: Just Whose Asset Is It?” will be included in BVR’s Guide to Personal and Enterprises Goodwill, which is expected to be published in March, 2010. This article considers several lines of cases analyzing the treatment of personal goodwill through the lens of section 546(a)(6) of the Bankruptcy Code as well as the practical implications to the debtor-professional training arising as a result of the chapter 7 trustee’s fiduciary duty to maximize value for the estate.
