John Stockdale, Jr. Settles Judgment against Guarantor

John Stockdale, Jr. assisted a post-judgment guarantor settle a judgment and stop the collection activity against him.  Several years ago the guarantor first retained Schafer and Weiner regarding a possible bankruptcy filing to discharge the guaranty judgment, but several potentially fraudulent transfers may have imperiled a bankruptcy discharge.  After the statute of limitations on denial of discharge expired, John prepared bankruptcy schedules and negotiated a pre-filing settlement of the guaranty liability that retired the judgment for only 5% of its face value and avoided the guarantor’s bankruptcy filing.
