Schafer and Weiner, PLLC Causes Individual Chapter 11 to be Dismissed

Only four months after a former husband entered into a consent judgment of divorce, he sought chapter 11 protection in the Eastern District of Michigan to renegotiate the terms of the consent judgment of divorce. John Stockdale, Jr. on behalf of the former wife took action to establish an unsecured creditors committee (which would be paid for by the former husband) and moved to lift the automatic stay to return the divorce-related issues to family court. After negotiations at the first meeting creditors, which allowed the former husband to avoid testifying, the former husband agreed to dismiss his bankruptcy case and pay all outstanding amounts owing to former wife.
