Representative cases include:
- Removed $1.5 million construction lien through fast-track bankruptcy court litigation. After two days of evidence and argument, the court agreed that the construction lien was invalid. Client then completed sale of the project instead of losing it to foreclosure.
- Defended mechanical contractor against personal liability claims under Michigan’s Builder’s Trust Fund Act. A violation of the Act had occurred, but the firm deflected a summary disposition motion with a novel theory: the contracting firm's president/owner had no personal liability because he had delegated responsibility for handling project funds to a qualified employee. We leveraged this theory into a favorable pre-trial settlement.
- Won $617,258 federal verdict for a developer against a general contractor and its president/owner, under Michigan’s Builder’s Trust Fund Act.
- Counseled architectural firm in multiple actions to foreclose construction liens. Client received full payment by foreclosing a construction lien on a leasehold interest at the Michigan State Fair Grounds.
