Real Estate Litigation
Representative cases include:
- Acted for large pension trust fund in foreclosing its mortgage on a $10 million Northern Michigan resort, obtaining deed in lieu in forced settlement. The firm successfully defended the pension fund against counterclaims, lender liability and established priority of the pension fund’s mortgage over multiple construction liens. The case led to a published Court of Appeals decision in 2005 (Stocker v. Tri Mount / Bay Harbor Building Co., 268 Mich. App. 194).
- Prevailed for landlord against commercial tenant to collect past-due lease payments and defend against counterclaims for interference with quiet enjoyment, constructive eviction and breach of contract. Negotiated settlement requiring payment of entire amount owed and dismissal of all counterclaims.
