Schafer and Weiner Obtain Appointment of Chapter 11 Trustee

Schafer and Weiner has been retained to represent the largest unsecured creditor in a single asset real estate case pending in the United States Bankruptcy Court for the Middle District of Georgia.  The creditor is also engaged in litigation with the Debtor, its principals, its lender, and others in the United States District Court for the Eastern District of Michigan.  Working with litigation counsel, Michael E. Baum and John Stockdale, Jr. responded to various first day motions, including the United States Trustee’s motion to convert or dismiss the case, by arguing for the appointment of a chapter 11 trustee.  After an in-person evidentiary hearing in the bankruptcy case, where John represented the creditor and presented evidence, the bankruptcy court agreed and appointed a chapter 11 trustee.
