Our attorneys assist trustees, receivers and assignees for the benefit of creditors and other fiduciaries who manage estate assets. Trustees rely on Schafer and Weiner’s skill and knowledge to administer a complex estate with multiple causes of action and assets. Representative cases include:
- Filed an involuntary petition to force an industry leading tooling manufacturer into involuntary bankruptcy proceedings, then represented Chapter 7 trustee to untangle interwoven assets of its many affiliates and shell companies set up by its majority shareholder. Our team convinced the bankruptcy judge to substantively consolidate several affiliates with the operating company, designed to maximize the proceeds for the operating company’s creditors. Next, we litigated successfully to seize the shell companies' assets, providing unsecured creditors with a significant distribution even in liquidation.
- Acted for a Chapter 7 trustee in involuntary bankruptcy of a large, grey iron foundry as a Tier Two automotive supplier.
- Represented a trust mortgage trustee in liquidating the assets of a Tier Two automotive supplier. Our firm spearheaded the sale of the business for going concern value, and successfully distributed these proceeds to creditors.
Trust us to help you successfully maximize fiduciary estate assets for the benefit of creditors.
