Restructuring

Today’s business environment can throw you all sorts of curve balls.  Perhaps you’ve had a change of ownership. Or you’re considering expanding your business and refinancing debt, or selling off underperforming divisions and reducing operations.

The corporate law attorneys at Schafer and Weiner are ready to assist you.  We have one of the country’s strongest restructuring teams.  Even larger, national firms can’t match our specialized expertise and bench strength.

With over 30 years of specialized insolvency and restructuring experience, we’ve designed, developed and executed reorganizations that help our clients successfully compete in diverse industries.  Recent representative cases include:

  • In re Shanta Corporation, et al. (skilled nursing and rehabilitation facilities) (2013).  Filed emergency Chapter 11 petitions within days of being hired, after the IRS froze the management company’s bank accounts.  During the case, the firm successfully negotiated with state and Federal regulators to allow for continued licensure and for Medicare and Medicaid reimbursement payments.  The debtors successfully confirmed a Chapter 11 restructuring plan that settled not only substantial secured and unsecured trade debt, but also millions of dollars of local, state and Federal taxes, allowing all three homes to stay in operation.
  • Regional Emergency Medical Service Company (2013 – present).  Schafer and Weiner currently represents an ambulance service in a pending workout with its secured creditor.  The firm pulled the company from the brink of an emergency Chapter 11 filing, negotiating a favorable forbearance agreement for the company that provided sufficient time to seek new financing to pay the existing bank and move forward with a new lender.  The firm negotiated an interim refinancing on behalf of the company with a specialty third party receivable lender, and is currently negotiating a complete refinancing of the company’s debt with a large regional bank.
