Schafer and Weiner, PLLC Secured Authority to Sell Tractors and Trailers

December, 2022

John Stockdale, Jr. and Joseph K. Grekin represent a trucking company in its liquidating subchapter V chapter 11 case.  Many of the debtor’s tractors and trailers are secured by a loan from Huntington Bank, which, in turn, is secured by a small business administration (“SBA”) guaranty.  In connection with the wind down, Schafer and Weiner, PLLC filed a motion to sell the vehicles, which Huntington contested.  After two hearings before the Bankruptcy Court, Schafer and Weiner, PLLC secured the debtor’s right to sell the vehicles over Huntington’s objection.
