Schafer and Weiner Resolve Collateral Conversion Claims

John Stockdale, Jr. and Leon N. Mayer represented a debt purchaser in litigation in Kent County Circuit Court involving claims of collateral conversion. This litigation was complicated because the claims were assigned to the debt purchaser by the plaintiff-debtor, but the plaintiff-debtor failed to disclose them. When the litigation was discovered, Schafer and Weiner, on behalf of the debt purchaser, intervened as the proper plaintiff. Through motion practice Schafer and Weiner resolved the matter by selling the underlying debt to the defendant. This cleared the way for the defendant to proceed against the plaintiff-debtor to collect the debt.
